These Terms & Conditions ("Terms") govern your use of the job application website at hiring.couchpotatoes.com (the "Site") operated by Couch Potatoes, a registered trade name (DBA) of CP Furniture Manufacturing LLC and Texas Business Development Group LLC ("Couch Potatoes," "we," "us," or "our"), and our applicant SMS text messaging program (the "Messaging Program"). By using the Site, submitting an application, or opting in to text messages, you agree to these Terms and to our Privacy Policy.
1. SMS messaging program terms
Program: Couch Potatoes Hiring Alerts.
Description: When you opt in, we will send you text messages about your job application, such as a link to complete your application, reminders, questions from our hiring team, invitations to visit the shop, scheduling confirmations, directions, and application status updates. Messages are informational and transactional; we do not send promotional or marketing texts through this program.
Opting in: You can opt in by checking the text-message consent box on our online application, by giving us written permission to text you (for example, in a job-board message or email), or by texting our hiring number first. Consent to receive text messages is not a condition of applying for or obtaining employment.
Message frequency: Varies by applicant and stage of the process; typically fewer than 10 messages per week.
Message and data rates may apply. Standard messaging rates from your wireless carrier apply to every message sent or received.
Opting out: Text STOP to any message to cancel at any time. After you send STOP, we will send you one message confirming you have been unsubscribed, and you will not receive further texts from us unless you opt back in by texting START. If you unsubscribe, we may still contact you by email or phone about your application unless you ask us not to.
Help: Text HELP to any message for assistance, email hiring@couchpotatoes.com, or call the number shown in our messages.
Supported carriers: Major U.S. carriers are supported. Carriers are not liable for delayed or undelivered messages.
Privacy: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. See our Privacy Policy.
2. Your responsibilities
- You must be at least 18 years old to use the Site or opt in to the Messaging Program.
- You confirm that you are the account holder or an authorized user of the mobile number you provide, and that you will tell us promptly if that number changes or is no longer yours.
- You agree to provide accurate and truthful information in your application.
- You agree not to misuse the Site, including by submitting automated or fraudulent applications, attempting to access other applicants' information, or interfering with the Site's operation.
3. Applications and employment
Submitting an application, completing our questions, or receiving messages from us does not create an offer of employment or a contract of any kind. All employment decisions are made by Couch Potatoes in its discretion and are subject to our standard hiring procedures, including in-person evaluation and verification of work eligibility. Couch Potatoes is an equal opportunity employer. Any employment is at-will unless otherwise stated in a signed written agreement.
4. Intellectual property
The Site, including its text, design, and software, is owned by Couch Potatoes or its licensors and is protected by applicable law. You may use the Site only to apply for a job with us.
5. Disclaimer of warranties
The Site and Messaging Program are provided "as is" and "as available." We do not guarantee that the Site will be uninterrupted or error-free, or that any text message will be delivered or delivered on time. Message delivery depends on your wireless carrier and device.
6. Limitation of liability
To the fullest extent permitted by law, Couch Potatoes and its owners, employees, and service providers will not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Site or Messaging Program, including any charges from your wireless carrier or any delayed, misdirected, or undelivered messages.
7. Changes to these Terms
We may update these Terms from time to time. The effective date at the top of the page shows when they were last revised. Continued use of the Site or Messaging Program after a change means you accept the updated Terms.
8. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Travis County, Texas.
